These Terms of Service ("Terms") govern your access to and use of the Vial iOS application and the vialpeptide.com website (together, the "Service"), operated by 185 Labs ("we", "us", "our"). By installing, accessing, or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. The Service is a logging tool, not medical advice
Vial is a personal logging utility. It records information you choose to enter and performs arithmetic on that information. Vial does not diagnose, treat, prevent, or cure any condition, and it does not recommend doses, schedules, or substances. Calculator outputs are mathematics applied to inputs you provide; they are not safety guidance.
You are solely responsible for the substances you choose to handle and the doses you choose to administer. Always consult a licensed healthcare provider for any question about what to take, how much, or when.
2. Eligibility and lawful use
- You must be at least 18 years old to use the Service.
- You must only log substances that you have legally obtained — by prescription or through channels that are lawful in your jurisdiction.
- You are responsible for understanding and complying with all laws that apply to your possession, handling, and use of any substance you log.
3. Subscriptions and payments
Vial offers a free tier and a paid subscription processed through your Apple ID and managed by Apple. Pricing, renewal terms, and free-trial details are presented in the app at the time of purchase.
- Payment is charged to your Apple ID at confirmation of purchase.
- Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period.
- You can manage and cancel subscriptions in your App Store account settings.
- Any unused portion of a free trial is forfeited when you purchase a subscription.
4. Your data
Vial stores your data locally on your device and synchronizes it across your own devices via your private iCloud account, using Apple's CloudKit. We do not operate a server that holds your log. Our handling of personal information is described in our Privacy Policy.
5. Apple Health
With your permission, Vial reads selected metrics from Apple HealthKit (such as weight, heart rate variability, resting heart rate, and sleep) at the time you view them. We do not copy this data to our servers. You can revoke HealthKit access at any time in iOS Settings.
6. Acceptable use
You agree not to:
- Use the Service in violation of any applicable law or regulation;
- Reverse engineer, decompile, or attempt to extract source code from the app, except as permitted by law;
- Resell, sublicense, or redistribute the Service or use it to provide a competing service to third parties;
- Misrepresent the Service as offering medical advice, diagnosis, or treatment to others, including in any professional or commercial context.
7. Intellectual property
The Service, including all software, designs, text, graphics, and trademarks, is owned by 185 Labs or its licensors and is protected by intellectual property laws. We grant you a limited, revocable, non-exclusive, non-transferable license to use the Service for your personal, non-commercial purposes, subject to these Terms.
8. Disclaimers
The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, or availability. We do not warrant that the Service will be uninterrupted, secure, or error-free.
9. Limitation of liability
To the maximum extent permitted by law, 185 Labs and its directors, employees, and affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising from or related to your use of the Service. Our aggregate liability for any direct damages arising from the Service will not exceed the amount you paid us in the twelve months preceding the claim, or USD $50, whichever is greater.
10. Indemnity
You agree to defend, indemnify, and hold harmless 185 Labs from any claim, demand, loss, or expense (including reasonable attorneys' fees) arising from your use of the Service, your violation of these Terms, or your violation of any law or third-party right.
11. Termination
You may stop using the Service at any time by uninstalling the app. We may suspend or terminate your access to the Service if you breach these Terms or use the Service in a way that creates risk for us or other users. The sections of these Terms that by their nature should survive termination will survive.
12. Changes to these Terms
We may update these Terms from time to time. When we make material changes, we will update the "Last updated" date at the top and, where appropriate, present the change in the app. Continued use of the Service after the change becomes effective constitutes acceptance of the updated Terms.
13. Governing law
These Terms are governed by the laws of the State of Delaware, USA, without regard to its conflict-of-laws rules. The courts of Delaware will have exclusive jurisdiction over any dispute arising from these Terms or the Service, except where applicable consumer-protection laws of your jurisdiction provide otherwise.
